Terms of Service

Eligibility

You must be at least 13 years old to use Flexi. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these age requirements. Users in the European Union must be at least 16 years old, or have parental consent.

Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information when creating your account.
• You may not share your account with others or create multiple accounts.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

Acceptable Use

You agree to use Flexi only for lawful purposes. You may not:

• Harass, bully, or threaten other users
• Post false, misleading, or offensive content in groups or community features
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or attempt to extract source code from the App
• Use automated systems or bots to access the App
• Manipulate workout data to gain unfair advantages in rivalries or challenges

User Content

You retain ownership of the content you create, including workout data, posts, and profile information. By using the App, you grant Flexi a worldwide, non-exclusive, royalty-free license to use, display, and process your content solely for the purpose of operating and improving the App. You may delete your content at any time, and we will remove it from our systems (subject to backup retention periods).

Intellectual Property

The App, including its design, features, code, graphics, and content (excluding user-generated content), is owned by Flexi and protected by intellectual property laws. "Flexi" and associated logos are trademarks. You may not copy, modify, distribute, or create derivative works based on the App without our written permission. Any feedback, suggestions, or ideas you provide about the App may be used by us without compensation or attribution to you.

Health and Fitness Disclaimer

• The App, including AI coach suggestions, does NOT provide medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare professional before starting any exercise program, especially if you have pre-existing health conditions, injuries, or concerns.
• You exercise at your own risk. Stop immediately and seek medical attention if you experience pain, dizziness, or discomfort during exercise.
• Flexi is not responsible for any injuries or health issues that may result from following workout suggestions or using the App.

AI Coach Services

Flexi includes an AI-powered coaching feature.

• The AI coach provides general fitness suggestions and motivation based on your data and preferences.
• AI suggestions are informational only and should not replace professional fitness or medical advice.
• The AI may occasionally provide inaccurate or inappropriate suggestions. Use your own judgment when following AI recommendations.
• Your conversations with the AI coach are processed by third-party AI services to generate responses.

Account Termination

• You may delete your account at any time from your profile settings.
• We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a risk to other users.
• Upon termination, your access to the App will cease, and your data will be deleted according to our Privacy Policy.

Disclaimers

• Flexi is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
• We make no warranties about the accuracy or reliability of workout tracking, progress calculations, or AI suggestions.
• Your use of the App is at your sole risk.

Limitation of Liability

To the maximum extent permitted by law, Flexi and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or health issues
• Loss of data
• Loss of profits or revenue
• Damages arising from your use of or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Flexi, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any content you post or share through the App
• Any injury or harm resulting from your exercise activities

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. For users outside Norway, local mandatory consumer protection laws may also apply to the extent they provide greater protection.

Dispute Resolution

• If you have a dispute with us, we encourage you to first contact us directly to seek a resolution.
• For EU residents, you may also use the European Commission's Online Dispute Resolution platform.
• Any legal proceedings must be brought in the courts of Norway, except where prohibited by local law.
• You agree to attempt to resolve disputes informally for at least 30 days before initiating any formal legal action.

Apple App Store Terms

If you downloaded the App from Apple's App Store, you acknowledge that:

1. These Terms are between you and Flexi only, not Apple
2. Apple has no obligation to provide maintenance or support for the App
3. Apple is not responsible for any product warranties, whether express or implied
4. Apple is not responsible for addressing any claims relating to the App
5. Apple is a third-party beneficiary of these Terms and may enforce them against you
6. You must comply with any applicable third-party terms when using the App

General Provisions

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flexi regarding the App.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.
• Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, government actions, or internet/infrastructure failures.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.
